1. What ETHPAID is
1.1. ETHPAID is a software service that helps merchants (the “Merchant”) accept payments in stablecoins (USDT, USDC) on Ethereum, BNB Chain, Base and Tron. 1.2. ETHPAID does not receive, hold or transfer the Merchant’s funds on its own behalf. Each invoice gets a smart-contract address that can only forward the tokens it receives to the wallet set by the Merchant (and, where applicable, the fee to ETHPAID’s address). The recipient is fixed when the invoice is created and cannot be changed. 1.3. ETHPAID is not a bank, payment institution, exchange or custodian and does not exchange crypto-assets for fiat money.
2. Who may use the service
2.1. Businesses, sole traders and individuals aged 18+ accepting payment for goods and services. 2.2. The service may not be used for the businesses listed in the AML policy (“Prohibited categories”) or by sanctioned persons and jurisdictions under comprehensive sanctions. 2.3. We may ask for information about the Merchant and its business and may refuse service without giving reasons.
3. The Merchant’s wallet
3.1. The Merchant chooses the payout wallet and is responsible for access to it. We do not hold keys and cannot restore access. 3.2. An own wallet is verified by signature. An exchange address is accepted for one network only; the exchange may not credit tokens arriving from another network or from a smart contract — this risk is the Merchant’s. 3.3. A wallet change takes effect after a delay (24–48 hours) and is notified.
4. Invoices and payments
4.1. An invoice has an amount, a payment window and addresses for the supported networks. For EUR invoices the rate is fixed when the invoice is created. 4.2. A payment counts as received once confirmed on the network. ETHPAID initiates the forward to the Merchant’s wallet and pays the network fee (gas) unless the plan says otherwise. 4.3. Underpayments, overpayments, late payments and payments on another network are handled as described on the website; funds are forwarded to the Merchant’s wallet whenever technically possible. 4.4. Refunds to buyers are made by the Merchant from its own wallet. ETHPAID helps obtain the buyer’s address but is not responsible for the refund.
5. Pricing
5.1. “Simple”: 1% of the amount received at the invoice address is kept by the smart contract. 5.2. “Saver”: 0.5% plus the actual gas cost are charged to the Merchant’s prepaid deposit. The deposit is not electronic money, is not redeemable for cash and is used only to pay for ETHPAID services. 5.3. Tron network fee: 1.47 USDT per payment; the Merchant chooses who pays it. 5.4. We may change prices with at least 30 days’ notice; new prices apply to new invoices.
6. Limitation of liability
6.1. Blockchains, wallets, exchanges and stablecoin issuers are third-party systems. We are not liable for their failures, delays, address blocking by issuers (Tether, Circle) or exchange-rate changes. 6.2. We are not liable for buyer mistakes (wrong amount, network or token) beyond the mechanisms in 4.3. 6.3. ETHPAID’s total liability is limited to the fees received from the Merchant in the 3 months before the event. 6.4. The service is provided “as is”. Test mode uses test networks and has no monetary value.
7. Security and suspension
7.1. We may suspend issuing new invoices if security is at risk; invoices already issued keep working. 7.2. Payments from sanctioned addresses are not forwarded automatically; further steps follow applicable law.
8. Taxes
The Merchant is responsible for its taxes and reporting. ETHPAID is not a tax agent.
9. Other
